Expertpedia Terms and Conditions

1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of Expertpedia's AI-enabled educational platform (the "Platform"), including our WhatsApp service, web application, and mobile application.

By accessing or using the Platform, you agree to be bound by these Terms. If you are under 18 years of age, your parent or legal guardian must accept these Terms on your behalf.

If you do not agree to these Terms, you may not access or use the Platform.

2. Definitions

• "Platform" refers to all Expertpedia services, including WhatsApp integration, web application, and mobile application
• "User," "you," or "your" refers to students, parents, guardians, teachers, or institutions using the Platform
• "We," "us," or "our" refers to Expertpedia and its authorized representatives
• "Content" refers to all educational materials, AI-generated responses, text, images, and other information available through the Platform
• "Services" refers to all educational assistance, learning resources, and features provided through the Platform
• "User Content" refers to queries, questions, images, documents, or other materials you submit to the Platform

3. Eligibility and Account Registration

3.1 Age Requirements

The Platform is designed for students in Classes 1-10 (typically ages 6-16). For users under 18 years of age:

• A parent or legal guardian must create and maintain the account
• The parent/guardian is responsible for all activities under the account
• The parent/guardian consents to the collection and processing of the student's data as described in our Privacy Policy

3.2 Account Registration

To use the Platform, you must:

• Provide accurate and complete registration information (mobile number, class, school, syllabus)
• Maintain the security of your account credentials
• Immediately notify us of any unauthorized access or security breach
• Accept responsibility for all activities conducted through your account

3.3 Account Restrictions

You may not:

• Create multiple accounts for the same student
• Share account access with unauthorized individuals
• Use another person's account without permission
• Provide false or misleading information during registration

4. Description of Services

4.1 Educational Services

Expertpedia provides:

• AI-powered educational assistance for Classes 1-10 across CBSE, ICSE, and State Board syllabi
• Curiosity-driven, assessment-free learning support
• Multi-modal access through WhatsApp and web application
• Educational content aligned with Indian curricula
• Conceptual explanations, practice problems, and learning guidance

4.2 Service Availability

While we strive for continuous service availability:

• Services may be temporarily unavailable due to maintenance, updates, or technical issues
• We do not guarantee uninterrupted access to the Platform
• Response times may vary based on query complexity and system load
• We reserve the right to modify, suspend, or discontinue features with reasonable notice

4.3 AI-Generated Content

Important limitations regarding AI-generated educational content:

• Content is generated by artificial intelligence and may contain errors or inaccuracies
• AI responses are meant to assist learning, not replace teachers or formal education
• Users should verify important information from authoritative sources
• We continuously work to improve accuracy but cannot guarantee perfection
• For critical educational decisions (exam preparation, subject selection), consult qualified educators

5. Subscription and Payment Terms

5.1 Service Tiers

Expertpedia offers multiple service tiers:

• Free Tier: Basic access to educational assistance with usage limits
• Premium Tiers: Enhanced features, unlimited queries, and priority support (subscription-based)
• Institutional Plans: Custom solutions for schools and educational institutions

5.2 Payment Terms

For paid subscriptions:

• Prices are displayed in Indian Rupees (INR) and are subject to applicable taxes
• Subscriptions are billed on a recurring basis (monthly or annual) unless cancelled
• Payment is processed through secure third-party payment gateways
• All fees are non-refundable except as required by law or explicitly stated

5.3 Free Tier Limitations

The Free Tier includes:

• Limited number of queries per day
• Access to core educational features
• Standard response times

Free Tier users may be asked to upgrade for:

• Unlimited queries
• Priority AI processing
• Advanced features (when introduced)
• Personalized learning analytics (when introduced)

5.4 Cancellation and Refunds

You may cancel your subscription at any time:

• Cancellation takes effect at the end of the current billing period
• You will retain access to paid features until the subscription expires
• No refunds for partial billing periods unless required by Indian consumer protection laws
• Refunds for technical issues or service failures are evaluated on a case-by-case basis

6. Acceptable Use Policy

6.1 Permitted Use

You may use the Platform for:

• Legitimate educational purposes aligned with Indian school curricula
• Seeking help with homework, concepts, and learning challenges
• Exploring educational topics out of curiosity
• Supplementing formal classroom education

6.2 Prohibited Use

You may NOT use the Platform to:

• Cheat on exams, tests, or assessments
• Submit AI-generated content as your own work without disclosure
• Abuse, harass, threaten, or harm others
• Share inappropriate, offensive, or illegal content
• Attempt to reverse-engineer, hack, or compromise the Platform
• Use automated tools or bots to access the Platform
• Resell, redistribute, or commercially exploit Platform content
• Violate any applicable laws or regulations

6.3 Enforcement

Violation of this Acceptable Use Policy may result in:

• Warning and request to cease prohibited activity
• Temporary suspension of account access
• Permanent termination of account without refund
• Legal action if violations involve illegal activity

7. Intellectual Property Rights

7.1 Platform Content

All content on the Platform, including:

• Software, algorithms, and AI models
• Educational materials and explanations
• User interface design and graphics
• Trademarks, logos, and branding

are owned by Expertpedia or our licensors and are protected by Indian and international intellectual property laws.

7.2 User Content - Your Rights and Our Limited License

Regarding content you submit (queries, images, documents):

Ownership: You retain all ownership rights to User Content you submit.

Limited License to Expertpedia: By submitting User Content, you grant us a limited, non-exclusive, non-transferable license to:

• Process your queries and generate AI-powered responses
• Transmit your queries to third-party AI service providers solely for real-time processing
• Store content temporarily in server memory during processing (deleted immediately after response delivery)
• Maintain backup copies for up to 90 days for disaster recovery and legal compliance purposes only

Duration: This license exists only for the duration of providing Services to you, plus a limited period thereafter (up to 90 days) for backup and legal compliance.

What We Do NOT Do: We do NOT:

• Use your queries for marketing or promotional purposes
• Train AI models using your content
• Share your queries with third parties (except AI processors for real-time service delivery)
• Create derivative works from your content
• Transfer this license to any other party
• Store your queries permanently (queries are deleted after processing)

7.3 AI-Generated Content Ownership

Regarding AI-generated responses provided to you:

Your License: You receive a non-exclusive license to use AI-generated responses for your personal educational purposes.

• You may use AI responses for learning, homework assistance, and educational understanding
• You may not redistribute, resell, or commercially exploit AI responses
• When submitting AI-assisted work to teachers or institutions, you must disclose AI usage as required by their policies

No Copyright Warranty: We make no warranty regarding the copyright status of AI-generated content. AI outputs may not be copyrightable or may have disputed ownership. Users assume all risk for use of AI-generated content.

7.4 Restrictions

You may not:

• Copy, modify, or distribute Platform content without permission
• Create derivative works based on the Platform
• Remove or alter proprietary notices or labels
• Use our trademarks or branding without authorization
• Scrape or systematically extract Platform content

8. Disclaimers and Limitations of Liability

8.1 Educational Content Disclaimer

IMPORTANT: While we strive for accuracy in all educational content:

• AI-generated responses may contain errors, omissions, or inaccuracies
• Content is provided "as-is" for general educational assistance
• We make reasonable efforts to ensure content quality but do not guarantee absolute accuracy
• Users should verify critical information from authoritative educational sources
• The Platform is a supplement to, not a replacement for, formal education and qualified teachers

8.2 Service Availability

The Platform is provided "as available":

• We do not guarantee uninterrupted, error-free, or secure service
• Technical issues, maintenance, or third-party failures may cause disruptions
• We are not liable for service interruptions beyond our reasonable control

8.3 Third-Party Services

The Platform integrates with third-party services (WhatsApp, AI providers):

• We are not responsible for third-party service failures or policies
• Links to external resources are provided for convenience only
• We do not endorse or control third-party content

8.4 Limitation of Liability

To the maximum extent permitted by Indian law:

• We are not liable for indirect, incidental, consequential, or punitive damages
• Our total liability shall not exceed the amount paid by you in the past 12 months
• We are not liable for damages arising from: incorrect AI responses, service interruptions, data loss, unauthorized access, or user misuse

Nothing in these Terms excludes liability that cannot be excluded under Indian law, including:

• Liability for fraud or fraudulent misrepresentation
• Liability for death or personal injury caused by our negligence
• Consumer rights under the Consumer Protection Act, 2019
• Rights under the Digital Personal Data Protection Act, 2023

9. Account Termination

9.1 Termination by User

You may terminate your account at any time by:

• Contacting us at support@expertpedia.io
• Following account deletion procedures in the Platform settings

Upon termination:

• Your access to paid features ceases immediately (no refund for partial periods)
• Your personal data will be deleted in accordance with our Privacy Policy (within 30 days)
• Backup copies may be retained for up to 90 days

9.2 Termination by Expertpedia

We may suspend or terminate your account if:

• You violate these Terms or our Acceptable Use Policy
• You engage in fraudulent, abusive, or illegal activity
• Your account is inactive for more than 12 months
• Required by law or regulatory authorities

Termination procedures:

• For violations: We may terminate immediately without refund
• For inactivity: We will provide 30 days' notice before deletion
• You may request data export before termination takes effect

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the jurisdiction of courts in Hyderabad, Telangana, India.

10.2 Dispute Resolution Process

In the event of any dispute:

• Step 1: Contact us at legal@expertpedia.io to attempt informal resolution
• Step 2: If unresolved within 30 days, either party may pursue mediation
• Step 3: If mediation fails, disputes may be resolved through arbitration or courts

10.3 Consumer Protection Rights

Nothing in these Terms limits your rights under:

• Consumer Protection Act, 2019
• Information Technology Act, 2000
• Digital Personal Data Protection Act, 2023
• Any other applicable consumer protection laws in India

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes:

• We will notify users via WhatsApp message, email, or Platform notification
• We will update the "Effective Date" at the top of this document
• Changes take effect 30 days after notification (or immediately for legal compliance)
• Continued use of the Platform after changes constitutes acceptance
• If you disagree with changes, you may terminate your account

12. General Provisions

12.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Expertpedia.

12.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force.

12.3 Waiver

Our failure to enforce any provision does not constitute a waiver of that provision or any other provision.

12.4 Assignment

You may not assign or transfer your rights under these Terms. We may assign our rights to any successor or affiliate.

12.5 Language

These Terms are written in English. Translations may be provided for convenience, but the English version shall prevail in case of conflicts.
